But who records all those great ideas, decisions, and action points? Where a colleague used to take notes by hand, an AI tool is now increasingly used. It automatically converts spoken text into meeting minutes. Convenient\u2014but is it GDPR-proof?<br \/><br \/><\/p>\n<h5>A quick refresher: what exactly does the GDPR entail?<\/h5>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The GDPR sets requirements for the processing of personal data. This is a broad concept. Anything that can identify a person falls under it: names, voices, email addresses, job titles, and so on. So if your AI note-taker recognizes participants in a meeting and stores their statements, the GDPR applies.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<h5>Silence means consent?<\/h5>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>The GDPR requires a legal basis <span class=\"tooltip-icon\" data-tooltip=\"We\u2019d be happy to explain the different legal bases for data processing.\">?<\/span> for each processing of personal data. There are six in total, the most well-known being \u2018consent\u2019. The consent <span class=\"tooltip-icon\" data-tooltip=\"Would you like to know how to properly apply the consent basis? We\u2019re happy to advise you.\">?<\/span> must be freely given, specific, informed, unambiguous, and demonstrable. A simple \u201cIs it okay if I use AI?\u201d is not sufficient. In addition, the GDPR sets requirements for aspects such as security and retention periods.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>When using an AI tool in your meeting, pay special attention to the following points:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul class=\"wp-block-list\">\n<li>Always ask all participants for consent before starting the AI tool (e.g., through a pop-up). Everyone must be able to give or refuse consent; do not start the tool if anyone says \u2018no\u2019.<\/li>\n<li>Include a link to your privacy statement <span class=\"tooltip-icon\" data-tooltip=\"In a privacy statement, you inform individuals about what you do with their personal data. We\u2019re happy to help.\">?<\/span> in the consent request mentioned above.<\/li>\n<li>Ensure that data is encrypted and that proper access management is in place.<\/li>\n<li>Include the AI tool in your processing register <span class=\"tooltip-icon\" data-tooltip=\"A processing register contains all information about the processing of personal data within your organization. You must delete personal data as soon as you no longer need it.<\/li>\n<\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>If you process special categories of personal data <span class=\"tooltip-icon\" data-tooltip=\"Would you like to know whether you process special categories of personal data and whether AI is suitable for this? In such cases, an AI note-taker is usually not a suitable solution unless you have explicit consent or there is an overriding public interest.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>In short: AI can take a lot of work off your hands, but only if used in a legally responsible way.
